Copyright and whether it has been infringed Free Essays

So as to have the option to settle the inquiry whether there has been copyright encroachment, the two fundamental standards to manage us is the material law and encroachment. The entries by the two gatherings to the debate were drawn from the government laws and an unmistakable locale is accommodated under the 1976 Copyright Act. Further, the entries by the gatherings were plainly on cases that are from the government courts and subsequently purview is anything but a begging to be proven wrong issue. We will compose a custom exposition test on Copyright and whether it has been encroached? or then again any comparable point just for you Request Now The other issue is on the subject of encroachment. As recently showed, the encroachment emerges when the copyright enrolled is utilized by another person who indicates to be the proprietor of that work. In this issue, the offended party didn't have his work enlisted, in any case, it's anything but a contested reality that the works had a place with the offended party and hence not an issue. The inquiry that does the trick for this situation is the similitude of articulation. The expectation of the Copyright demonstration is to secure the author’s articulation of thought and not simply the thought. In the current case the offended party had brought to the respondent the work which the litigant was to investigate and choose whether it was a smart thought or not, in any case, the litigant proceeded to pass the attempts to another outsider who went to be his operator to affirm the work and rather took his thoughts and a report was delivered with that impact. The aim of the tenet is to ensure the authors’ articulation. So as to settle this inquiry the court takes a gander at the idea of articulation is it communicated in horde ways or in thin ways? In the above case, the articulation is communicated in limited structure and in this way there is similitude of articulation from the archive which was created by the outsider, who was working together with the respondent thus, it is along these lines right to present that there was encroachment by the litigant. Regardless of whether there is a suggested agreement of certainty? The issue of whether that there existed an agreement is one which can't go disregarded. The dependable guideline is that all agreements must be recorded as a hard copy. Be that as it may, the case before us is that, there is no composed agreement between the gatherings and in this way the issue of inferred agreement of reality emerges. Regardless of whether there is an inferred agreement of truth, the test will be applied to the aims and lead of the gatherings. An agreement inferred in truth will develop the entire understanding, further it is an agreement that is made when a gathering implicitly acknowledges advantage at a time it had the option to dismiss it. In the current case, it is the finding of the court and truth that the offended party had given the litigant original copy and that they would utilize it for the reason which was planned and should they do in any case then the offended party ought to have go thought. In showing up to this end the court takes a gander at the goal and the direct of the two gatherings at the hour of creation of the contact. It is obvious from the direct of the respondent particularly from the second solicitation for the composition that there was goal to make an inferred agreement of reality. For the court to come to the end result that in fact the litigant was in break is all together and in this way the offended party ought to be granted the cures that go with the same pattern because of the respondent penetrating the agreement. Under the California laws which the offended party had argued under, the courts can implement for cures. Regardless of whether the influencing issues will influence the judgment of the court? There are different issues that legitimately and by implication influence the result of the case this incorporate; †¢ Exclusion of prattle Evidence †¢ Denial of Motion to alter †¢ Finding of certainty †¢ Statute confinements †¢ Attorneys expenses It is trite law that the noise proof won't be conceded on record spare that it meets the exemption rule. The issue for this situation is whether in the preliminary courts’ finding the rejection was all together. In the conditions, the rejection was all together since the proof which the gatherings had indicated to bring under the watchful eye of the court was showed by an outsider and plainly couldn't and noise henceforth didn't fall inside the exemption rules. Movement to correct can be given if certain lawful standards and edge are met with the gathering trying to depend on it. The hidden rule is that, the Motion to correct can be given and on the off chance that it doesn't look to preference the other party. In the prior situation, a movement to correct was brought 19 months from the time the issue was documented in court and saw with doubt. The main end that was shown up by the courts is that it was carried with the point of thwarting the wheels of equity and it was legitimate for the court to deny the equivalent. The weight of verification movements to the individual who claims, in the prior conditions if the offended party made charges and supported utilizing proof which they did, at that point it tends to be held as the confirmed certainty. In introducing their proof, the offended party supported his proof and was not shaken by the protection and in this manner the court is right to discover their situation as reality. The issue of constraints goes to back when the reason for activity emerged. It is the defendants’ accommodation that it is time banned under the California laws. The courts are guided from when the activity emerged for this situation after the litigant neglected to make great the installment and which was inside time when the respondent was filling this suit which is presently a condition point of reference. The general guideline is that the losing gathering should pay the expenses. For this situation, the litigant lost the case and further, it is our accommodation that the case was brought under the government laws copyright Act of 1976 that the gathering liable should pay the supporters costs. All in all, in this manner it is my unassuming accommodation that the offended party has satisfied the necessary edge on matter of parity of likelihood and thus achieved the opportunity of progress. Paragraph Writing How to Write a Good Paragraph

Paragraph Writing How to Write a Good Paragraph Although there are many opinions on how many types of essays there are, everyone seems to agree on what you need to formulate a good paragraph. Youll probably have read that a sentence expresses a single idea. A paragraph is a group of sentences dealing with a similar idea. As soon as you move on to a new set of ideas, you move on to a new paragraph. When you create an essay outline, you will probably list ideas that need to be included in your essay. If youre thinking clearly, each of these ideas would have a paragraph to itself. If some of the ideas you jotted down are closely related, theyd probably form part of the same paragraph. Crafting a Paragraph In a way, you could see each paragraph as a mini-essay. You introduce the topic You provide the contributing information You draw a conclusion But how do you know if you have crafted a good paragraph? It will have four characteristics: Unity Order Coherence Completeness You achieve these four characteristics through using the three parts of your paragraph wisely and with forethought. First Sentence The first sentence in a paragraph is important, and its called the topic sentence. It should represent the overall idea that governs the rest of the paragraphs content. Its the sames as your essay introduction leads into your essay. All the sentences that follow will contribute to this topic sentence. For example, in this paragraph, I began by telling you that the paragraph starts with a topic sentence. Now I am telling you what it is for, and how it relates to the other sentences in the paragraph. If you do this well, youll achieve the first of our characteristics: unity. Contributing Sentences Your contributing sentences must lead logically to the concluding one. This means you need to present it in some kind of order. Will you choose chronological order, order of importance, or relate each successive sentence to the other using logic? That depends on what you are writing about, but your aim is to make your paragraph easy to follow from point A to point B to point C. Finally, you want to tie all your points together to underline the point you are trying to get across. Order helps to convey the sense of what you are saying. If you confuse your reader, you have not written a clever paragraph. Order Should Bring Coherence Have you ever listened to someone talking, and it sounds like theyre just babbling and not making any sense? They are speaking incoherently. When a person speaks coherently, each thought follows neatly from the previous one, and it is easy to understand what they are saying. Although its not a must, using transition words helps to show how one thought relates to another. There are many such words and phrases which include: Because In addition By contrast Next Afterward Accordingly No doubt Of course On the other hand Naturally Also After Before Another important trick to remember is to keep all your sentences in the same verb tense. It just makes it so much easier for your reader to follow your thoughts. Your Concluding Sentence Dont leave your reader wondering So what? at the end of your paragraph. Pull your threads together into a concluding sentence. It should support your introductory sentence while acknowledging what you have discussed in the supporting sentences. This helps your reader to see how the supporting information relates to the topic. You may think it is obvious, but your reader may not! Practice Writing a really good paragraph is something of an art, but like any skill, you can learn it through practice. Thats why teachers will set paragraph writing tasks for their students. But if you love writing, or just want to improve your writing skills, theres no reason why you shouldnt set yourself a few tasks. Choose from a list of paragraph writing prompts, or make up a list of your own. Here are some ideas: Why I enjoy my hobby so much My favorite winter activity My opinion on _________ (Choose anything you like) Why I hope to become a ___________ I think the most important thing about a person is __________ Why I admire my best friend My favorite season is ___________ My most embarrassing moment was when_________ The thing Im most scared of What I dreamed last night Remember, keep it to one paragraph! After youve written it, leave it for a while because its hard to evaluate your own work right away. Later, go and look at your exercise. Ask yourself: What is my opening sentence? Do my other points support it? Did I reach a conclusion, and does it match the opening sentence and the supporting ones? Have I presented my information in a logical way? Could I have done it better? Writing a paragraph isnt all that difficult, but you cant just run at it like a bull at a gate. If you think things through, youll find yourself naturally falling in with the rules weve discussed here. Thoughtful work is usually good work, so engage your grey matter and get writing!

Effects Of The War On The Vietnam War Essay - 1478 Words

The calamitous American involvement in the Vietnam war exposed a plethora of social and political ambiguities in 1960s society. The loss of the war can be attributed to a number of things - poor foreign policy, Johnson’s failure to adequately justify American involvement, the lack of direction for the war or viable strategy, and U.S. troops being unable to compete with the foreign terrain of Vietnam. In this essay I will argue that among the numerous reasons the war was lost, three were the most notable: American arrogance and the â€Å"disease of victory,† the incompetence of the U.S. government to handle a war of such scale, and, at a more practical level, the insoluble mix of American troops with Vietnamese territory and foliage. As a combination, it can be discerned that the Vietnam War was a war America could never win. The confidence of America in its strength and durability of institutions harks back to the early years of the republic, with the nation feeling it was its duty to ‘spread the blessings of liberty and plenty to other lands.’ This rhetoric of their ‘providential destiny’ only grew stronger over the twentieth century, and as a result of the victory of World War II, America entered Vietnam as a ‘crusader state’ with a skewed perception of their military capabilities and strength as a nation. It has been reported that the information stored by the company is vulnerable to major security risks that may result in the breach of security and loss of vital information of the company as well as its companies (Jouini et al., 2014). According to a study conducted recently, the information system of eBay can easily be hacked and compromised by unethical hackers by insertion of malicious codes and viruses. All these can easily be misused by the unethical hackers. This will also result in significant financial loss and reputation of the company. Potential Solutions There are several potential solutions for the issue. Firstly, the company has to install security firewall softwares in all the systems used by the employees. Secondly, the company has to employ security experts to secure the cloud servers where the majority of the information is stored (Zissis Lekkas, 2012). Antoni Gaudi essays

Antoni Gaudi essays Antoni Gaudi was a Spanish architect, born on 25th June 1852 in Reus. He attended secondary school in the Colegio de los Padres Escolapios also in Reus in 1863. Gaudi also attended preparatory courses in 1869 to enable him to study architecture at the Faculty of Natural Science at Barcelona University. In 1873 Gaudi studied architecture at the Escola Provincial dArchitectura in Barcelona and just before finishing his studies he was awarded a public contract to design street lamps for the City, which were installed in 1879. On the 15th March 1878, Gaudi received his diploma. Gaudi died in early 1926. Gaudis earliest architectural work was the Casa Vicens, built in 1878, which was a private home in Barcelona. Gaudi has also created other works, such as the Sagrada Familia, Casa Batllo and the Casa Mila. They all show Gaudis style, described as a blend of Neo-Gothic and Art Nouveau. Gaudi was inspired by mosaics but has interpreted them in his own way. Instead of flat, angular shapes, Gaudi creates smooth, shaped and curved 3D forms, and there are virtually no straight lines. Gaudi also includes shapes from natural forms, such as lizards, snakes and mushrooms. These forms can all be found in Park Guell. Gaudis rounded, unique wavelike style also reminds me of movement, although not straightforward, but a slow, wavy movement. His work and style also remind me of space, as most of his works are large especially the Casa Mila. The Casa Mila is my favourite of Gaudis buildings. It is also known as La Pedera or the Quarry, as it is a large stone and iron building, and is a pale colour with ironwork details. The outside is very smooth and wavy and has been described as a moving landscape by Josef Wiedermann. The stone is rounded and reminds me of a large cliff by the sea, as the walls appear to have been eroded by the elements. ...

Bailing out Corporate America - Reflective Paper Research

Bailing out Corporate America - Reflective - Research Paper Example Sound familiar, as you can see, it was written in 1991. This very same scenario can be seen in new articles from 1943, 1980, 1991, and now 2008. The American people say that they do not want to reward greed by bailing out the corporations but greed is not the real problem. The real problem is that it fails the American dream. How might we define the American dream? It is more than cars and money. James Adams was the first to actually attempt to define it. That definition was of â€Å"a land in which life could be better and richer and fuller for everyone, with opportunity for each according to ability or achievement.† This is a dream that European upper classes might have some difficulty in interpreting and now many of our own are having trouble hanging on to. Americans have become weary and mistrustful of it. It is a dream about a social order in which each man and woman shall attain their fullest potential of which they are innately capable of being recognized by others for what they are regardless of the circumstances from which they came. This is the dream that is being lost to Americans who are working hard and losing to companies who are not. From the time we are young children, we are taught, if we work hard and do well, we will be rewarded. Essential to the American dream is the belief that you will be rewarded if you are successful. This is so much a part of the society and culture that it also becomes part of the ethics of the culture. If you work hard throughout your life, you will have what you want and maybe more. This is where the anger really comes from. Greed is part of the American dream. All Americans are greedy. Americans do not hope to have just enough, they hope to have everything they can get but they expect to get it by working hard, doing a good job, and being successful (Sandel, 2009) anything else is considered theft. Why then, are we rewarding with millions of dollars those companies

The Foreign Policy In The USSR During And After The Cold War Essay

The Foreign Policy In The USSR During And After The Cold War - Essay Example As the animosity between the Communist Soviet Union and the Capitalist United States spread to various countries all over the world, the eventual result was that both Asia and Europe were divided with almost all countries on the two continents being granted the option of willingly pledging their alliance with either of the two powers or being forced into accepting an alliance. Hitler’s suicide and the subsequent end of the World War II was seen to be a crucial catalyst in the ushering in of a new era marked by widespread decolonization as well as the liberation of most of the countries that had previously been enslaved (McCannon, 2010). These newly liberalized countries were seen to be battling with numerous challenges including widespread territorial divisions as well as the problem of having bankrupt economies, this situation inadvertently leads to the countries experiencing a large-scale exodus of refugees. The Capitalistic and Communist Nations were quick to utilize this o pportunity and started to attempt to influence these newly liberated countries by offering them financial aid (Bulliet, 2009).  This move by the two opposing powers was seen to further fuel their ongoing rivalry. The Cold War was seen to be mainly characterized by numerous numbers of both international and domestic military coalitions, espionage developments, wide spread armament race, rampant political propaganda as well as particularly destructive technological developments.   Gradually, this Cold War saw the development of nuclear arms as well as a space race between the warring countries of the USSR and United States. It happened to be quite ironic that the newly liberated countries were being forced to essentially become part of a world that happened to now be polarized into two factions that forced these countries to essentially align themselves and support either one of the two superpower blocs. However, not all countries opted to join the two super power blocks with coun tries such as India and Yugoslavia opting to rally and form a

One work three ways Essay Example for Free

One work three ways Essay An art is a product of human creativity. It is an orderly behavior of an artist and has connected concepts. An artist consciously embeds clarity, harmony and balance to the creation. Immediately, after an event, exhibition, movie or play, one can read a detailed description of the same of how good or bad was the event, or the merits and demerits of the exhibition, how emotional or neutral was the role of the actor or actress. Critics analyze these things with great profundity. Any art which proves to be evergreen is associated with the core and in-depth feelings of human behavior. There are certain feelings and emotions such as love, hatred, fear, hunger, pain, acceptance, disgust, sadness, joy which form the integral part of every human being. The artistic creations touching the sensitive aspects of the human behavior leave an everlasting impact on the minds of the people. The past analysis to the history of greatest hits in any form of art shows that such hits were closely associated to the very intense feelings. The people in general find the connectivity of the events associated with their lives and then readily show like or dislike for a particular artistic creation. Take an example of a legendary song or painting which depicts or reflects deception. One can hardly find a person who has never been deceived. Now, because such deep feelings are immortal so become the depiction of such feelings.

Symbolism in Daisy Miller by Henry James :: Henry James, Daisy Miller

The story of Daisy Miller starts off in Vevey, Switzerland with Winterbourne and Daisy meeting through Daisy's brother Randolph. Winterbourne is immediately attracted to her stating, "she was strikingly, admirably pretty" (James 470). The story continues with Winterbourne giving Daisy a tour of the Chateau de Chillon, and Winterbourne returning to Geneva, where he had an older women waiting for him. Daisy ends up meeting an Italian man, Giovanelli, which eventually leads to her death of malaria. Although the characters seem simple enough, they symbolize much more than themselves. In Henry James's Daisy Miller, Daisy symbolizes all American women who travel abroad to Europe, while Winterbourne symbolizes the European mentality of American tourists. Daisy is the "pretty American flirt" throughout the novella (James 474). She is nice and sweet, but also rebellious and ignorant. Daisy really does not care what society thinks of her. You see this throughout the course of the novel when she goes to Chillon with Winterbourne alone and when she frolics the streets at night with Giovanelli. Most Europeans look down upon American travelers in Europe, especially when they do not follow the customs and culture of their country. This is something that still has not changed today. The Miller family treats their carrier, Eugenio, like one of the family. Typically carriers live and sleep on the lower levels of the house, while Eugenio sleeps on the same level and interacts with the family. This is something that stands out to Winterbourne's aunt, Mrs. Costello because that is unheard of in European culture. When Winterbourne tells Mrs. Costello about Daisy, you can see the symbolism already becoming very prevalent, "They are very co mmon; they are the sort of Americans that one does one's duty by not- not accepting" Mrs. Costello feels very strongly about the Americans in a negative way. She refuses to be introduced to Daisy and tells Winterbourne that she should be more like his cousins from New York. Ironically enough, he has heard that his cousins are "tremendous flirts" (James 478). This is interesting because of Winterbourne's belief that all American girls are flirts. Daisy did not help her case any of being the typical American flirt when she goes to Italy and meets many different men, including Giovanelli. If the Europeans have not met many Americans and the usually the ones that can afford to travel are rich, they can only assume what America is by what they have seen.

Discuss the social context that influences Othello’s labelling of Desdemona as that “cunning whore of Venice”

In Othello many issues are undertaken. According to the time that the play was written, men hold all the power and women are considered to be of low intellect. Throughout the play Desdemona is a symbol of innocence and helplessness. At first she appears to be mature and quite perceptive of events around her. Iago often tells Othello that she is unfaithful. It seems that she refuses to accept what is happening and her views are impartial. She has a tendency to be sympathetic towards other people's situations, like Cassio. This is what triggers Othello's jealousy when Iago pointed out they were speaking in privacy. She often pays attention to other peoples thoughts yet remains cynical if they differ to her own. She has a loyalty to her husband in all aspects of life, whether it is mental or physical. Othello shows us how a woman's character, reputation and power can be manipulated and distorted by men. The relationship between Desdemona and Othello is very peculiar, and would have been considered even more so at the time at which Shakespeare was writing, it therefore stands out in the play, not least because it is a mixed-race marriage but also because at the start of the play they appear to be on an equal standing, they have a mutual â€Å"respect† for one another. We are presented with a very powerful image of women at the start of the play; Desdemona has disobeyed her father and taken her chosen husband, although Desdemona does acknowledge that Othello is her â€Å"Lord† and that it is her â€Å"duty† to obey him. However, in that state, Desdemona does act as a dramatic device, bringing Othello into a domestic situation where he is inexperienced. This causes his obsession with Desdemona to grow because she has become his whole world; Iago finds it easy to manipulate this situation because Othello is unfamiliar to life only in the domestic side. Although Desdemona was rational in trusting, her trust was often misplaced, for example Iago. As well as this regardless of her intellect of what goes on around her in some cases, this was not enough to rise up in society, as women had no opinion in the time of the play. Although Shakespeare undertook many modern day ideas, he did not do this for a modern day society, as it would not have allowed so many events to occur, and it would not have been considered realistic by the public. When Othello talks of wooing Desdemona he is portrayed as an eloquent storyteller and lover: â€Å"She gave me for my pain a world of sighs. † It is through her relationship with Othello that his failure is shown not only by her spoilt opinion of him, he was previously an ideal to her, but by the end of the play she has realised that â€Å"men are not gods†, but also by Othello's swift dismissal of her as a â€Å"fair devil† and a â€Å"lewd minx† after his view of her where he would â€Å"deny her nothing† has been destroyed by Iago. The downfall of Othello is marked by the destruction of their once close and trusting relationship, which Iago has convinced Othello that it is a â€Å"foul disproportion. † Desdemona's physical and vocal absence from the opening scenes speaks about women's place in the Venetian society. It is through Desdemona's absence that we are able to conjure up our own mental image of her based on what we have heard.
